A BILL TO BE ENTITLED

AN ACT directing the department of transportation to maintain and keep in repair certain private driveways used by public school buses for the purpose of turning the school bus around.

The General Assembly of North Carolina enacts:

SECTION 1.  G.S. 136‑18(17) reads as rewritten:

"(17)    The Department of Transportation is authorized and required to do all of the following:

a.         The Department of Transportation is hereby authorized and required to maintainMaintain and keep in repair, sufficient to accommodate the public school buses, roads leading from the state‑maintained public roads to all public schools and public school buildings to which children are transported on public school buses to and from their homes.

b.         Said Department of Transportation is further authorized to construct,Construct, pave, and maintain (i) school bus driveways and sufficient parking facilities for the school buses at those schools. The Department of Transportation is further authorized to construct, pave, and maintainschools eligible under sub‑subdivision a. of this subdivision and (ii) all other driveways and entrances to the public schools leading from public roads not required in the preceding portion of this subdivision.otherwise covered under this sub‑subdivision.

c.         Maintain and keep in repair any private driveway used by a public school bus for the purpose of turning the school bus around. To be eligible under this sub‑subdivision, the owner of the private driveway must submit written consent to the superintendent of the local school administrative unit where the school to which the school bus is assigned is located, authorizing the driveway to be used for the purpose of turning the school bus around, and the superintendent must forward that written consent to the Department of Transportation."

SECTION 2.  This act is effective when it becomes law.
