SENATE BILL 189

 

AN ACT TO PROVIDE THAT THE AUTHORITY OF THE PRESIDENT PRO TEMPORE OF THE SENATE AND THE SPEAKER OF THE HOUSE OF REPRESENTATIVES CONCERNING THE JOINT LEGISLATIVE COMMISSION ON GOVERNMENTAL OPERATIONS IS THE SAME.

 

The General Assembly of North Carolina enacts:

 

Section 1.  G.S. 120-74 reads as rewritten:

"§ 120-74. Appointment of members; terms of office.

The Commission shall consist of 22 members. The President of the Senate, the President pro tempore of the Senate, the Speaker pro tempore of the House, and the Majority Leader of the Senate and the Speaker of the House shall serve as ex officio members of the Commission. The Speaker of the House of Representatives shall appoint nine members from the House. The President pro tempore of the Senate shall appoint eight nine members from the Senate. Vacancies created by resignation or otherwise shall be filled by the original appointing authority. Members shall serve two-year terms beginning and ending on January 15 of the odd-numbered years, except that initial appointments shall begin on July 1, 1975. Members shall not be disqualified from completing a term of service on the Commission because they fail to run or are defeated for reelection. Resignation or removal from the General Assembly shall constitute resignation or removal from membership on the Commission. The terms of the initial members of the Commission shall expire January 15, 1977."

Sec. 2.  G.S. 120-75 reads as rewritten:

"§ 120-75. Organization of the Commission.

The President pro tempore of the Senate and the Speaker of the House of Representatives shall serve as cochairmen of the Commission.  Either of the cochairmen may call a meeting of the Commission."

Sec. 3.  G.S. 120-78 reads as rewritten:

"§ 120-78. Compensation and expenses of Commission members.

Members of the Commission, who are also members of the General Assembly, shall receive subsistence and travel expenses at the rates set forth in G.S. 120-3.1 for General Assembly members.  The President of the Senate shall receive subsistence and travel expenses at the rates set forth in G.S. 138-6.  The Commission shall be funded by the Legislative Services Commission from appropriations made to the General Assembly for that purpose."

Sec. 4.  This act is effective upon ratification.
