HOUSE BILL 1079

 

AN ACT TO PROVIDE FOR RULES FOR PRECERTIFICATION PRACTICES IN HEALTH CARE REIMBURSEMENT MECHANISMS.

 

The General Assembly of North Carolina enacts:

 

Section 1.  Article 27 of Chapter 58 of the General Statutes is amended by adding a new section to read:

"§ 58-260.7.  Rules for precertification practices.

(a)       This section applies to all accident and health insurers under this Chapter, all third-party administrators and preferred provider arrangements, all entities subject to Chapters 57 and 57B of the General Statutes, and all self-funded health benefit plans.

(b)       The Commissioner shall adopt reasonable rules governing precertification practices and forms and utilization review organizations affiliated with the entities subject to this section."

Sec. 2.  Within one year after the effective date of this act, the Commissioner of Insurance shall give notice of hearing under G.S. 150B-12 for the rules required by Section 1 of this act.

Sec. 3.  This act is effective upon ratification.
