HOUSE BILL 228

 

AN ACT TO STAY DEVELOPMENT UNDER CAMA PERMITS WHILE REQUESTS FOR APPEALS ARE PENDING.

 

The General Assembly of North Carolina enacts:

 

Section 1.  G.S. 113A-121.1(d) is amended to read:

"(d)      Upon receipt by the Commission of a request for an appeal pursuant to this section, the permit subject to appeal shall be considered to be suspended and no development shall be undertaken which would be unlawful in the absence of a permit under this Part."

Sec. 2.  G.S. 113A-121.1(c) is amended by adding a sentence at the end thereof to read:

"A decision on whether to grant a request for appeal pursuant to this subsection shall be issued within 15 days of receipt of the request."

Sec. 3.  This act is effective upon ratification.
