HOUSE BILL 466

 

AN ACT TO AMEND THE CHARTER OF THE CITY OF STATESVILLE.

 

The General Assembly of North Carolina enacts:

 

Section 1.  The Charter of the City of Statesville, as the same is found in Chapter 289, Session Laws of 1977, is amended by deleting therefrom Sections 8.2 through 8.6, inclusive, and by rewriting Section 8.1 to read:

"Sec. 8.1.  Procedure for assessments. Assessments for street or sidewalk improvements shall be made pursuant to, and in accordance with, Article 10 of Chapter 160A of the General Statutes, provided that the City Council may levy special assessments for street or sidewalk improvements without regard to the receipt or non-receipt of a petition for said improvements; provided further, that not more than fifty percent (50%) of the cost of the improvement may be assessed (not including the cost of improvements made at street intersections), unless a petition for the improvements, signed by at least a majority in number of the owners of property to be assessed, who must represent at least a majority of all the lineal feet of frontage of the lands abutting on the street or sidewalk or portion thereof to be improved, requests a higher percentage."

Sec. 2.  This act is effective upon ratification.
