AN ACT TO AUTHORIZE THE TOWN OF BEAUFORT TO ACQUIRE OPEN SPACE LAND BY EMINENT DOMAIN.

 

The General Assembly of North Carolina do enact:

 

Section 1. In addition to such other powers of eminent domain as may now or hereafter be granted by general or local law to the Town of Beaufort, the town is hereby empowered and authorized to acquire by eminent domain the fee or any lesser interest, development right, easement, covenant, or other contractual right of or to real property within its corporate limits, for the purposes specified in Article 14A of Chapter 160 of the General Statutes. In the exercise of the power granted by this Section, the town shall follow the procedure provided in Article 2 of Chapter 40 of the General Statutes.

Sec. 1.5. This Act shall not apply to the following area: Beginning at a concrete monument, the southeast corner of the present town corporate boundary as shown on the Plan of Beaufort and marked B-11; running thence westwardly and with the various courses of the South town boundary as shown by the above-mentioned Plan and with said boundary extended to the center of Beaufort Channel; thence southwardly with the center line of Beaufort Channel along the following courses and distances: South 8 degrees 35 minutes East 1200 feet; South 46 degrees 40 minutes West 900 feet; South 84 degrees 00 minutes West 1800 feet; South 19 degrees 15 minutes West 1875 feet; South 11 degrees 25 minutes East 1800 feet to Bulkhead Light; thence South 80 degrees 30 minutes East 3600 feet; thence South 80 degrees 00 minutes East 8100 feet, more or less, to the present East town corporate boundary line extended; thence with said East town corporate boundary line North 14 degrees 05 minutes East to the point of Beginning.

Sec. 2. All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 3. This Act shall be effective upon its ratification.
