AN ACT TO AMEND G.S. 113-152 AND G.S. 113-154, SO AS TO EXEMPT FROM LICENSING REQUIREMENTS OF PERSONS AND VESSELS TAKING OYSTERS AND CLAMS FOR THEIR PERSONAL USE.

 

The General Assembly of North Carolina do enact:

 

Section 1.  G.S. 113-152 (a), as the same appears in the 1966 Replacement Volume 3A of the General Statutes is amended by adding a new paragraph to the end of that Section as follows:

"Nothing contained in this Section shall require the licensing of any vessel used solely for clamming or oystering by a person not required to have a clam and oyster license under the provisions of G.S. 113-154. Spears or gigs shall not be deemed commercial fishing equipment unless used in an operation the purpose of which is the taking of fish for commercial purposes."

Sec. 2.  G.S. 113-152 as the same appears in the 1966 Replacement Volume 3A of the General Statutes is amended by adding a new subsection at the end thereof to read as follows:

"(f)       No persons exempt from the Oyster and Clam Licenses under the provisions of this Section may take more than one bushel of oysters and clams in the aggregate on any one day."

Sec. 3.  G.S. 113-154(b) as the same appears in the 1966 Replacement Volume 3A of the General Statutes is amended by adding the words "for commercial use" after the word "clams" and before the word "from" in line 1 of said subsection.

Sec. 4.  All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 5.  This Act shall be in full force and effect from and after its ratification.
