AN ACT TO AMEND SECTION 3 OF THE CHARTER OF THE CITY OF DURHAM, BEING CHAPTER 142, PRIVATE LAWS 1921, AS AMENDED FROM TIME TO TIME, IN REFERENCE TO DIVISION OF THE CITY OF DURHAM INTO WARDS AND VOTING PRECINCTS.

 

The General Assembly of North Carolina do enact:

 

Section 1. That each of the six wards of the City of Durham, as hereinafter redefined and rearranged, contain approximately equal population.

Sec. 2. That so much of Section 3 of the Charter of the City of Durham, being Chapter 142, Private Laws 1921, as amended from time to time, as divides the City of Durham into six wards, is hereby amended and rewritten to hereafter read as follows:

"Sec. 3. Division into wards and voting precincts. The territory comprised within the corporate limits of the City of Durham is hereby laid off into six wards as follows:

"Ward Number One: Ward Number One shall be comprised of that territory lying in that section of the City of Durham bounded as follows, to wit:

BEGINNING at the intersection of the center line of Duke Street with the center line of the North Carolina Railroad and running thence along and with the center line of Duke Street in a northerly direction to the center line of Duke Homestead Road; and thence in a northeastwardly direction from that point to the center line of Denfield Street; thence along the center line of Denfield Street in a northeastwardly direction to the present city limits line; thence along the present city limits line in a northerly direction to the northern city limits line; thence along and with the northern city limits line in a westwardly and southerly direction to a point; thence continuing along the northern city limits line in a westwardly direction to a point in the western city limits line; thence along and with the western city limits line in a southerly direction to a point North of Kirkwood Drive at which the city limits line turns westwardly, and thence from said point in a southeastwardly direction to the center line of Guess Road; thence along and with the center line of Guess Road in a southerly direction to U. S. Highways 15-501-70; thence southeastwardly to a point in the intersection of the center line of Sovereign Street with the center line of Carolina Street; thence along and with the center line of Carolina Street in a southerly direction to the center line of Hillsborough Road; thence westwardly along the center line of Hillsborough Road to its intersection with the center line of Bolton Street; thence along the center line of Bolton Street projected in a straight line in a southerly direction to the center line of the North Carolina Railroad; thence along and with the center line of the North Carolina Railroad in an eastwardly and southeastwardly direction to the center line of Duke Street, the point of BEGINNING.

"Ward Number Two: Ward Number Two shall be comprised of that territory lying in that section of the City of Durham bounded as follows, to wit: BEGINNING at the point of intersection of the center line of Duke Street with the center line of North Carolina Railroad and running thence along the center line of the North Carolina Railroad in an eastwardly and southeastwardly direction to a point at the intersection of North Carolina Railroad and Norfolk and Western Railroad right of way; thence in a northwardly direction along the center line of the Norfolk and Western Railroad right of way to the center line of U. S. Highways 70-15; thence along the center line of U. S. Highways 70-15 in an easterly direction to the center line of U. S. Highway 15; thence along the center line of U. S. Highway 15 in a northeasterly direction to the eastern city limits line; thence along and with the eastern, northeastern and northern boundary line of the city limits to a point at the intersection of the city limits line with the center line of Denfield Street; thence along and with the center line of Denfield Street in a southwestwardly direction to the center line of Roxboro Street; thence continuing in a southwestwardly direction in a straight line to the center line of Duke Homestead Road and Duke Street; thence along and with the center line of Duke Street in a southerly direction to the center line of the North Carolina Railroad, the point of BEGINNING.

"Ward Number Three: Ward Number Three shall be comprised of that territory lying in that section of the City of Durham bounded as follows, to wit: BEGINNING at the intersection of the center line of Mangum Street with the center line of the North Carolina Railroad and running thence along the center line of Mangum Street in a southerly direction to the center line of Hillside Avenue; thence along the center line of Hillside Avenue westwardly to the center line of South Street; thence southwardly along the center line of South Street to the center line of Roxboro Street; thence southwestwardly and southwardly along the center line of Roxboro Street to the center line of North Oakridge Boulevard; thence southwardly to the southern boundary of the city limits line; thence along and with the southern boundary of the city limits line to a point in the eastern boundary of the city limits line; thence continuing with the city limits line in a northwardly, eastwardly, westwardly and northwardly direction to the city limits line lying South of Cecil Street; thence continuing along the city limits line in an eastwardly and northeastwardly direction to the center line of the North Carolina Railroad; thence westwardly along the center line of the North Carolina Railroad to its intersection with the center line of Mangum Street, the point of BEGINNING.

"Ward Number Four: Ward Number Four shall be comprised of that territory lying in that section of the City of Durham bounded as follows, to wit: BEGINNING at the intersection of the center line of the North Carolina Railroad and the center line of Mangum Street and running thence westwardly along the center line of the North Carolina Railroad to its intersection with the center line of Buchanan Boulevard; thence along the center line of Buchanan Boulevard in a southerly direction to the center line of Chapel Hill Street; thence along the center line of Chapel Hill Street in a westerly direction to the center line of Kent Street; thence along the center line of Kent Street in a southerly direction to the center line of Morehead Avenue; thence along the center line of Morehead Avenue in a westwardly direction to the center line of Anderson Street; thence along the center line of Anderson Street in a southerly direction to the center line of Chapel Hill Road; thence along the center line of Chapel Hill Road in a southerly direction to its intersection with the center line of University Drive and Dixon Road; thence along the center line of Chapel Hill Road westwardly, southerly and westwardly to the western city limits boundary line where it intersects with the center line of Chapel Hill Road; thence following the western city limits line in a general southerly direction to its terminus South of N. C. Highway 54; thence continuing along and with the city limits boundary line in a general northeasterly direction as it meanders to a point southwest of the point at which Roxboro Street intersects with North Oakridge Boulevard; thence in a northerly direction to the point of intersection of the center line of North Oakridge Boulevard with the center line of Roxboro Street; thence along the center line of Roxboro Street in a northerly direction to the point of its intersection with the center line of South Street; thence northerly along the center line of South Street to its intersection with the center line of Hillside Avenue; thence along the center line of Hillside Avenue in an easterly direction to its intersection with the center line of Mangum Street; thence along the center line of Mangum Street in a northerly direction to its intersection with the center line of the North Carolina Railroad, the point of BEGINNING.

"Ward Number Five; Ward Number Five shall be comprised of that territory lying in that section of the City of Durham bounded as follows, to wit: BEGINNING at the intersection of the center line of North Carolina Railroad with the center line of Buchanan Boulevard and running in a westerly direction along the center line of North Carolina Railroad to the center line of Bolton Street; thence in a northeastwardly direction to and along the center line of Bolton Street to its intersection with the center line of Hillsborough Road; thence along the center line of Hillsborough Road in an easterly direction to its intersection with the center line of Carolina Street; thence along the center line of Carolina Street in a northerly direction to the center line of Sovereign Street; thence in a northwestwardly direction in a straight line to the intersection of the center line of Guess Road with the center line of the northern ramp of U. S. Highways 15-501 and 70 (I-85); thence along and with the center line of Guess Road in a northerly direction to its intersection with the center line of Kirkwood Drive; thence in a northwestwardly direction in a straight line to the point at which the city limits line forms a right angle; thence along and with the city limits line as it meanders in a westwardly, southerly and southwestwardly direction to a point North and West of Chapel Hill Road; thence along the city limits line in a southwestwardly direction to a point to the West of Winding Way; thence following the city limits line in a southeasterly direction to its intersection with the center line of Chapel Hill Road; thence along the center line of Chapel Hill Road in an easterly and northerly direction to its intersection with the center line of University Drive and the center line of Dixon Road; thence continuing along the center line of Chapel Hill Road in a northeasterly direction to its intersection with the center line of Anderson Street; thence along the center line of Anderson Street in a northerly direction to its intersection with the center line of Morehead Avenue; thence along the center line of Morehead Avenue in an easterly direction to its intersection with the center line of Kent Street; thence along the center line of Kent Street in a northerly direction to its intersection with the center line of Chapel Hill Street; thence along the center line of Chapel Hill Street in an easterly direction to its intersection with the center line of Buchanan Boulevard; thence along the center line of Buchanan Boulevard in a northerly direction to its intersection with the center line of the North Carolina Railroad, the point of BEGINNING.

"Ward Number Six: Ward Number Six shall be comprised of that territory lying in that section of the City of Durham bounded as follows, to wit: BEGINNING at a point in the center line of North Carolina Railroad at its intersection with the center line of the right of way of Norfolk and Western Railroad lying East of Fayetteville and Rowland Streets; thence along the center line of the Norfolk and Western Railroad right of way in a northerly direction to the center line of U. S. Highways 70-15; thence along the center line of U. S. Highways 70-15 in an easterly direction to the center line of U. S. Highway 15; thence along the center line of U. S. Highway 15 in a northeasterly direction to the eastern city limits line; thence along and with the meandering of the eastern city limits boundary line in a general eastwardly and southerly direction to the city limits boundary line which is 50 feet North of the center line of the main line track of the North Carolina Railroad; thence along and with the city limits boundary line in the right of way of the North Carolina Railroad in a general westwardly and northwestwardly direction to the intersection of the center line of the North Carolina Railroad and Norfolk and Western Railroad, the point of BEGINNING."

Sec. 3. All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 4. This Act shall be in full force and effect from and after its ratification.
