AN ACT TO REORGANIZE AND MERGE THE ANSON COUNTY ADMINISTRATIVE SCHOOL UNIT, THE WADESBORO CITY SCHOOL ADMINISTRATIVE UNIT AND THE MORVEN CITY SCHOOL ADMINISTRATIVE UNIT INTO ONE SCHOOL ADMINISTRATIVE UNIT UNDER ONE BOARD OF EDUCATION FOR ALL THE PUBLIC SCHOOLS IN ANSON COUNTY.

 

The General Assembly of North Carolina do enact:

 

Section 1. On and after July 1, 1967, the Wadesboro City Board of Education shall cease to exist and the terms of office of the members of its Board of Education shall end and terminate, and said Wadesboro City Board of Education shall no longer operate and administer any of the public schools in the Wadesboro City Administrative Unit. On and after July 1, 1967, the Morven City Board of Education shall cease to exist and the terms of office of the members of its Board of Education shall end and terminate, and said Morven City Board of Education shall no longer operate and administer any of the public schools in the Morven City Administrative Unit.

Sec. 2. On and after July 1, 1967, all of the public schools of Anson County shall operate as a part of the Anson County School Administrative Unit and said public schools shall be under the jurisdiction, administration and operation of the Anson County Board of Education which shall consist of seven members elected for six-year terms of office, except that the initial Board of Education which shall assume authority on July 1, 1967, shall consist of the following: Glenn K. Martin, whose term of office shall expire on the first Monday in December, 1970; G. E. Tucker, whose term of office shall expire on the first Monday in December, 1972; and J. P. Adcock, whose term of office shall expire on the first Monday in December, 1974. The above three members being from the geographical area of the present Anson County School Administrative Unit. There shall be two members from the present geographical area of the Wadesboro School Administrative Unit, as follows: J. D. McLeod, whose term of office shall expire on the first Monday in December, 1970, and James A. Hardison, Jr., whose term of office shall expire on the first Monday in December, 1972; and, two members being from the geographical area of the present Morven School Administrative Unit, as follows: W. E. Steagall, Jr., whose term of office shall expire on the first Monday in December, 1970, and, Charles Ratliff, whose term of office shall expire on the first Monday in December, 1974; or, until their successors are elected and qualified, in each and every case, as hereinafter provided. The members of said Anson County Board of Education as named in this Section shall take the oath of office on July 1, 1967, or as soon as practicable thereafter, and shall immediately organize itself by electing a chairman, vice-chairman, and such other officers as may be required and consistent with the public school law as set forth in Chapter 115 of the General Statutes, as amended. The Superintendent of Schools shall serve as secretary to the Board.

Sec. 3. At the primary and general election to be held in Anson County in the year 1970, there shall be nominated and elected three members of said Anson County Board of Education whose terms of office shall be for six years. The nomination and election of said members shall be at the same time and in the same manner as candidates are nominated and elected for county officers and shall be governed by the applicable provisions of Chapter 163 of the General Statutes, as amended, pertaining to primaries and elections for county officers. At the primary and general election to be held for the nomination and election of county officers for the year 1972, there shall be nominated and elected three members of the Anson County Board of Education whose terms of office shall be for six years, and at the primary and general election for county officers of Anson County to be held in the year 1974, there shall be nominated and elected one member of the Anson County Board of Education whose term of office shall be for six years. All candidates elected to membership on the Anson County Board of Education shall qualify by taking the oath of office on or about the first Monday in December following their election and their term of office shall become effective with the date of their qualification. All candidates elected to membership on the Anson County Board of Education shall hold their offices until their successors are elected and qualified. Thereafter, as vacancies occur in the office or offices of the members of the Anson County Board of Education by reason of the expiration of terms of office, there shall be nominated and elected the required number of members of said Board of Education for the purpose of filling said vacancies, and all successors in said office or offices shall be nominated and elected for terms of office of six years each.

Sec. 4. All candidates for nomination and election as members of the Anson County Board of Education shall be residents and electors of Anson County and shall file a written notice with the Chairman of the Anson County Board of Elections stating their name, age and residence and in case there is more than one vacancy to be filled on said Board of Education the candidate shall state in said notice the particular vacancy for which he is a candidate, and in addition thereto the said notice shall be filed with the Chairman of the Anson County Board of Elections at least 30 days on or before the date of said primary. All candidates for election to membership to said Anson County Board of Education shall be voted on at large by the eligible voters and electors of Anson County, and in case there shall be more than one candidate then the candidates receiving the highest number of votes shall be nominated and elected, and there shall be no second primary. All vacancies on the first or initial Anson County Board of Education caused by death, resignation, removal or change of residence, removal from office or otherwise, shall be filled by the remaining members for the unexpired term of office but such appointments to fill vacancies on the first or initial Anson County Board of Education shall be filled or made by persons residing within the geographical area from which said initial appointments were made. All vacancies on the Anson County Board of Education composed of the elected members and caused by the reasons set forth above shall be filled by the remaining members of the Anson County Board of Education for the unexpired term. The members of the Anson County Board of Education, including the first or initial Board of Education as herein provided, shall be paid the sum of ten dollars ($10.00) per day for each day of their official meetings for the transaction of official business.

Sec. 5. The supplemental tax heretofore authorized and levied for the benefit of the public schools located in the Wadesboro City Administrative Unit shall continue to be levied and collected according to the previous authorization and the proceeds of said tax levy shall continue to be used to increase and enrich the public school program and for the benefit of the children of said Wadesboro City Administrative Unit in which said supplemental tax is levied. The Commissioners of the Town of Wadesboro, the governing authority of said Town of Wadesboro, shall nominate two members and the Board of Commissioners of Anson County shall nominate one member and all three nominees shall be sent to the Anson County Board of Education who shall appoint said nominees as members of a district school committee for the territory in the Wadesboro City Administrative Unit. Each of said members of said school committee shall be appointed for a term of two years, and said school committee shall submit annually a budget to the Anson County Board of Education as to the expenditures of the proceeds from said supplemental tax levy and shall also annually make recommendations to the Board of County Commissioners of Anson County as to what portion, if any, of said supplemental tax shall be levied. In this connection said school committee shall perform the budgetary and fiscal functions as provided by public law for a school committee and these functions only.

Sec. 6. On and after July 1, 1967, the Anson County Board of Education heretofore constituted and whose members shall take office on said date, and their successors in office, shall receive and hold all assets, liabilities, obligations, properties, funds and unexpended balances heretofore held by the Wadesboro City Board of Education and by the Morven City Board of Education, and said city boards of education shall transfer to the newly created Anson County Board of Education all documents, contracts, books, papers, letters and any and all files and accounting records relating to all the public schools existing within the newly reorganized Anson County School Administrative Unit. The newly created Anson County Board of Education assuming authority on July 1, 1967, shall have the power and authority to consolidate and take over any and all budgets which shall have been previously prepared by the Wadesboro City Board of Education and by the Morven City Board of Education and approved by the Board of County Commissioners.

Sec. 7. The Anson County Board of Education which shall assume authority on July 1, 1967, shall at its first meeting elect a superintendent for a two-year term expiring July 1, 1969. At the same time the said Board is authorized and empowered, upon recommendation of the Superintendent, to elect such assistant superintendents, associate superintendents and other personnel as shall be required for the official administration and operation of the schools administered by the Anson County Board of Education. The term of office and the period of service for all personnel elected then and thereafter shall be subject to and in accordance with the provisions of Chapter 115 of the General Statutes, as amended, and the rules and regulations of the State Board of Education governing school personnel, except that after the initial election for the superintendent of schools the superintendent shall be elected on or about the first Monday in April, 1969, and biennially thereafter, for a term of two years, beginning July first next following his election.

Sec. 8. The Wadesboro City Board of Education and the Morven City Board of Education shall continue to exist and operate and administer the public schools in their respective school administrative units as in the past until July 1, 1967, and all new members appointed to said city boards of education shall be appointed for terms to commence on April 1, 1967, and expire July 1, 1967.

Sec. 9. All laws and clauses of laws in conflict with the provisions of this Act are hereby repealed.

Sec. 10. This Act shall be in full force and effect from and after its ratification.
