AN ACT TO ALLOW STATE EMPLOYEES AND TEACHERS WHO ARE OVER AGE SIXTY (60) WHEN EMPLOYED TO BECOME ACTIVE MEMBERS IN THE RETIREMENT SYSTEM.

 

WHEREAS, the 1957 General Assembly extended State matching of contributions for retirement for employees age 60 and through age 65; and

WHEREAS, the 1963 General Assembly extended State matching of contributions for retirement for employees past age 65; and

WHEREAS, the public schools find it necessary to recall to service persons who have retired to relieve the critical shortage of teachers: Now, therefore,

 

The General Assembly of North Carolina do enact:

 

Section 1.  Section 135-3, subdivision (6), of the General Statutes is hereby amended by rewriting the sentence to read:

"Any person who became, or becomes, a 'teacher or employee' after attaining age 60, as the terms are defined in this Chapter, may be a member of the Retirement System effective the date of re-entering service by signing the proper enrollment forms as specified by the Trustees and by paying contributions at the current rate, plus interest, if any."

Sec. 2.  All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 3.  This Act shall become effective upon its ratification.
