AN ACT TO AMEND THE CHARTER OF THE TOWN OF KENANSVILLE SO AS TO PROVIDE FOR THE ELECTION OF THE MAYOR AND MEMBERS OF THE BOARD OF COMMISSIONERS.

 

The General Assembly of North Carolina do enact:

 

Section 1. Section 3 of Chapter 174, Private Laws of 1899, is hereby rewritten to read as follows:

"Sec. 3. The governing body of the Town of Kenansville shall consist of a mayor and five commissioners who shall be elected by the qualified voters of the town as herein provided. The regular municipal election shall be held on Tuesday after the first Monday in May of 1969, and biennially thereafter.

In the municipal election of 1969, and quadrennially thereafter, the candidate for mayor receiving the highest number of votes shall serve for a term of four years and until his successor is elected and qualified. In 1969 the two candidates for commissioner receiving the highest number of votes shall be elected for terms of four years each, and the three candidates for commissioner receiving the next highest number of votes shall be elected for terms of two years each. In 1971, and biennially thereafter, the candidates for commissioner, equal to the number of positions to be filled, receiving the highest number of votes shall be elected for terms of four years each and shall serve until their successors are elected and qualified. In 1969 the two candidates for commissioner receiving the highest number of votes shall be elected for terms of four years each, and the three candidates for commissioner receiving the next highest number of votes shall be elected for terms of two years each. In 1971, and biennially thereafter, the candidates for commissioner, equal to the number of positions to be filled, receiving the highest number of votes shall be elected for terms of four years each and shall serve until their successors are elected and qualified.

The persons elected shall qualify immediately after the certification of their election by taking the oath of office to which elected."

Sec. 2. The present mayor and members of the board of commissioners shall continue in office until their successors are elected as provided herein. The municipal elections shall be conducted and held in accordance with the provisions of Article 3, Chapter 160 of the General Statutes of North Carolina, except as otherwise provided herein.

Sec. 3. All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 4. This Act shall be in full force and effect from and after its ratification.
