AN ACT TO AMEND ARTICLE 4B OF CHAPTER 106 OF THE GENERAL STATUTES SO AS TO PROHIBIT AIRCRAFT APPLICATION OF PESTICIDES WITHIN TWO MILES OF THE CORPORATE LIMITS OF ANY CITY OR TOWN.

 

The General Assembly of North Carolina do enact:

 

Section 1.  G.S. 106-65.14 is hereby amended by adding a new paragraph at the end thereof to read as follows:

"Notwithstanding any other provisions of this Article, it shall be unlawful for any person, firm, association or corporation to make any application of pesticides by aircraft within two miles of the corporate limits of any incorporated city or town in this State, provided that this prohibition is not applicable if and when the State Health Director shall determine that a health menace exists which would justify the use of pesticides in this manner; provided further that when a health menace due to insect borne diseases exists any spraying or dusting performed pursuant to Act shall be done under the supervision of the Department of Agriculture."

Sec. 1 1/2.  This Act shall apply only to Henderson County.

Sec. 2.  All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 3.  This Act shall be in full force and effect from and after its ratification.
