AN ACT TO PROVIDE FOR THE NOMINATION AND ELECTION OF MEMBERS OF THE BOARD OF EDUCATION OF MADISON COUNTY.

 

The General Assembly of North Carolina do enact:

 

Section 1. The Board of Education of Madison County shall consist of five members who shall serve for terms of four years each, and until their successors are elected and qualified.

Sec. 2. For the purpose of nominating and electing members of the Madison County Board of Education, the County shall be divided into two districts as follows:

District One shall be composed of Townships 3, 4 and 7, as now known and constituted.

District Two shall be composed of Townships 1, 2, 5, 6 and 8, as now known and constituted.

Sec. 3. At the primary election to be held for County officers in 1970, and quadrennially thereafter, two candidates shall be nominated by each political party from District One, and three candidates shall be nominated by each political party from District Two. Candidates must be residents of the District in which they are nominated, and shall file notice of candidacy indicating the District for which they are candidates, and their party affiliation.

The candidates shall be nominated by the qualified voters of the District in which the candidates are running. The names of the nominees, of each political party, from each District shall be placed upon the County ballot at the next succeeding general election.

Sec. 4. In the general election of 1970, and quadrennially thereafter, separate ballots for each District shall be prepared by the County Board of Elections, and only the qualified voters of each District shall vote for the candidates nominated from that particular District. The candidates, equal to the number of positions to be filled in each District, receiving the highest number of votes in the District shall be declared elected.

Sec. 5. Vacancies in the membership of the Board of Education, for any cause, shall be filled immediately by the County Executive Committee of the political party of the member causing such vacancy. The person appointed shall serve for the unexpired term.

Sec. 6. The persons elected in the general election of 1970, and quadrennially thereafter, shall take office on the first Monday in April following their election, and the Board of Education shall organize on said date by electing one member as Chairman. In the event a vacancy occurs in the Chairmanship, the Board of Education shall elect a successor.

Sec. 7. Except as otherwise provided herein, the primary and general elections shall be conducted and held in accordance with the laws and regulations governing primary and general elections as provided in Chapter 163 of the General Statutes of North Carolina.

Sec. 8. If any Section, subsection, clause or provision of this Act shall be adjudged invalid, such adjudication shall apply only to such Section, subsection, clause or provision, and the remainder of this Act shall be deemed valid and effective.

Sec. 9. All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 10. This Act shall be in full force and effect from and after its ratification.
