AN ACT TO AMEND CHAPTER 18 OF THE GENERAL STATUTES RELATING TO BEER AND WINE ELECTIONS.

 

The General Assembly of North Carolina do enact:

 

Section 1.  Chapter 18 of the General Statutes of North Carolina, Section 124, subsection (f), shall be amended by adding the following at the end of subsection (f):

"Provided, however, that if, in any petition filed pursuant to the provisions of G.S. 18‑124, or G.S. 18-127, or other provision, it shall be requested that an election be held on the same day as any election called to determine whether Alcoholic Beverage Control Stores should be operated in any city or county, the city or county board of elections or the governing body of any municipality, as the case may be, may call the election on the same day as the election on Alcoholic Beverage Control Stores. In such case the question of Alcoholic Beverage Control Stores shall be placed on a separate ballot from any other question."

Sec. 2.  Chapter 18 of the General Statutes of North Carolina, Section 124, subsection (b), shall be amended as follows: by striking out in line two of said subsection the words and figures "fifteen per cent (15%)" and inserting in lieu thereof the words and figures: "twenty-five per cent (25%)".

Sec. 3.  Chapter 18 of the General Statutes of North Carolina, Section 127 shall be amended by striking out in line four of said Section the figures "15%" and inserting in lieu thereof the figures: "25%".

Sec. 4.  General Statutes 18-127.1 is amended by striking out in line five of said Section the words and figures "fifteen per cent (15%)" and inserting in lieu thereof the words and figures: "twenty-five per cent (25%)".

Sec. 5.  All laws and clauses of laws in conflict herewith are repealed.

Sec. 6.  This Act shall be in full force and effect from and after the 1st day of July, 1963.
