AN ACT TO AUTHORIZE THE RECOVERY OF CIVIL DAMAGES DUE TO THE MALICIOUS OR WILFUL DESTRUCTION OF PROPERTY BY MINORS.

 

The General Assembly of North Carolina do enact:

 

Section 1.  Article 43 of Chapter 1 of the General Statutes is amended by adding a new Section immediately preceding G.S. 1‑539, to be designated as G.S. 1‑538.1 and to read as follows:

"G.S. 1‑538.1.  Any person, firm, corporation, the State of North Carolina or any political subdivision thereof, or any religious, educational or charitable organization, or any nonprofit cemetery corporation, or organization, whether incorporated or unincorporated, shall be entitled to recover damages in an amount not to exceed five hundred dollars ($500.00), in an action in a court of competent jurisdiction, from the parents of any minor under the age of eighteen (18) years, living with its parents, who shall maliciously or wilfully destroy property, real, personal or mixed, belonging to any such person, firm, corporation, the State of North Carolina or any political subdivision thereof, or any religious, educational or charitable organization."

Sec. 2.  All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 3.  This Act shall be in full force and effect from and after its ratification.
